Planimate Evaluation User Licence Agreement

LEVEL 0: EVALUATION

Under the Planimate Evaluation Version Subscription Licence InterDynamics Pty Ltd grants to the subscriber account a licence to use a copy of Planimate subject to the following conditions, as the law permits:

The subscriber account holder must assign a nominated user who will only use their copy of Planimate for the purpose of evaluation of the software.

The evaluation period shall be 90 days from the date of creation of the Key File that is delivered to the nominated user.

Only the nominated user is permitted to use the rights granted under this Planimate Evaluation Version Licence.

This licence is not transferable to another individual without prior approval from InterDynamics Pty Ltd.

By the end of the 90-day evaluation period, the subscriber account holder must have taken up and paid for an appropriate annual subscription, or the nominated user must cease using the Planimate software.

If more than 90 days is required to perform the evaluation, please contact InterDynamics Pty Ltd to make suitable arrangements.

Duplication of the software or its documentation, in any form except for archival purposes, is illegal and will result in prosecution to the full extent of the law. The subscriber account holder remains responsible for ensuring that no illegal duplication of this software occurs.

The software is not guaranteed bug free. InterDynamics Pty Ltd shall not be held liable for any damages, including any lost savings, lost profits or other incidental or consequential damages incurred from the use or inability to use this software. InterDynamics Pty Ltd shall not be responsible for any damages claimed by any other party, resulting from the use of this software.

LEVEL 1: EDUCATIONAL USE

Under the Planimate Educational Use Subscription Licence InterDynamics Pty Ltd grants to the subscriber account a licence to use a copy of Planimate subject to the

The subscriber account holder must be a person authorized to agree to this licence on behalf of the School/Department within which Planimate is deployed.

Planimate may be deployed within the school/department and used for educational purposes ONLY.

Student use of the software on computers outside of the school/department is approved, where the subjects they are studying in the school/department require the use of the software.

The school/department may serve copies of the software to its students as long as the location of the files is in a restricted-access area, to ensure that neither the software installation set, nor the enabling key file are effectively “public domain”.

Use by the school/department of Planimate in public demonstrations and marketing is approved.

The length of the Licence Subscription Period is 12 months.

Use of the program by the school/department for commercial consulting purposes is beyond the terms of this licence, and will require a model developer subscription licence to be taken up.

Supply of the software to other schools/departments is not approved under this licence. Each school/department that wishes to use the program is required to sign an individual licence agreement.

LEVEL 2: MODEL END USER

Under the Planimate Model User Subscription Licence InterDynamics Pty Ltd grants to the subscriber account a licence to use a copy of Planimate subject to the following conditions, as the law permits:

The subscriber account holder must assign a nominated user who can use a version of Planimate to load a Planimate model, enter and edit various parameters and perform model runs to investigate scenario options.

The nominated user is not permitted to edit the structure of a Model.

The length of the Licence Subscription Period is 12 months.

Only the nominated user is permitted to use the rights granted under the Planimate Model User Subscription Licence.

This licence is not transferable to another individual without prior approval from InterDynamics Pty Ltd.

InterDynamics reserves the right to make modifications and enhancements to the software without notice, and to charge for upgrades.

LEVEL 3: MODEL DEVELOPER

Under the Planimate Model Developer Subscription Licence InterDynamics Pty Ltd grants to the subscriber account a licence to use a copy of Planimate subject to the following conditions, as the law permits:

The subscriber account holder must assign a nominated user who can use a version of Planimate for the purposes of building, editing and running a Planimate model.

The nominated user may also use a version of Planimate to compile and distribute Planimate-based Applications (PBA’s) using key files supplied by InterDynamics Pty Ltd. A key file is required for each PBA, and InterDynamics Pty Ltd reserves the right to charge a fee for the supply of each key file.

The length of the licence subscription period is 12 months.

Only the nominated user is permitted to use the rights granted under the Planimate Model Developer Subscription Licence.

This licence is not transferable to another individual without prior approval from InterDynamics Pty Ltd.

The Nominated User is not permitted to compile PBA’s for third parties, whether or not a fee is charged.

InterDynamics reserves the right to make modifications and enhancements to the software without notice, and to charge for upgrades.

LEVEL 4: APPLICATION COMPILER

Under the Planimate Open PBA Compiler Subscription Licence InterDynamics Pty Ltd grants to the subscriber account a licence to use a copy of Planimate subject to the following conditions, as the law permits:

The subscriber account holder must assign a nominated user who has also been assigned a current a subscription to a Planimate Model Developer Licence.

The nominated user can use Planimate to compile and distribute unlimited Planimate-based Applications (PBA’s) without having to request key files from InterDynamics Pty Ltd.

The length of the Licence Subscription Period is 12 months.

Only the nominated user is permitted to use the rights granted under the Planimate Open PBA Compiler Licence.

This licence is not transferable to another individual without prior approval from InterDynamics Pty Ltd.

A Planimate Open PBA Compiler Licence subscriber account holder is not permitted to nor allow any nominated user to compile PBA’s for third parties, whether or not a fee is charged.

InterDynamics reserves the right to make modifications and enhancements to the software without notice, and to charge for upgrades.
